This contest is open to legal Canadian residents who have reached the age of majority in the province in which they reside at the time of entry. Not open to residents of Québec. Employees of Jones Apparel Group Canada (the “Sponsor”), and it’s affiliates, subsidiaries, divisions, parent and related companies, suppliers, printers and advertising, promotional and judging agencies and the household members of any of the above are not eligible to enter or win.
Contest begins at 12:01 a.m. on 02/26/09 and ends at 11:59 p.m. EST on 03/31/09. You may enter this Contest via either the on-line or mail-in entry methods described below. No purchase necessary to enter the contest. Illegible or incomplete entries will be disqualified. All entries are the property of the Sponsor and will not be returned.
You may enter the Contest via the internet by logging on to www.jonesnewyorkcontest.ca. All on-line entries must be received by 11:59 p.m.
Alternatively, you may enter the Contest by sending your name, address and telephone number to Jones Apparel Group Canada, 388 Applewood Crescent, Vaughan, Ontario, Canada, L4K 4B4. All entries must be postmarked by the last day of the contest (March 31, 2009) and received no later than April 5, 2009.
There will be a total of one (1) Grand Prize awarded in the form of a gift card in the amount of Cdn $1,000.00 redeemable at the following choice of stores: Jones New York Sherway Gardens, Jones New York Factory Stores or Jones New York Finale Stores in Canada (excluding Quebec) for JONES NEW YORK, ANNE KLEIN or NINE WEST clothing and accessories. The Grand Prize Winner is required to sign a standard declaration of eligibility, a liability release, a publicity release, and any other documentation that the Sponsor may require. No transfer, substitution, or cash equivalent for the Prize permitted.
A total of one (1) winning entry will be selected from among the eligible entries received by random draw at Jones Apparel Group Canada head office at 388 Applewood Crescent, Vaughan, Ontario, L4K 4B4 on 04/20/09 at 10am EST. The Winner will be notified by email or telephone on 04/20/09. In order to win, the eligible entrant whose entry is selected must correctly answer a skill testing mathematical question.
The odds of winning depend on the number of eligible entries received.
By entering this Contest and / or accepting the Prize, the Winner hereby consents to the reasonable use of the entrants’ entry form and it’s contents, without any further compensation, for any promotional activity related to this Contest. Winner and entrants agree and consent that all entries become the property of the Sponsor and none will be returned for any reason.
In order to win the Prize, the selected entrant will be required to execute a legal agreement and release (“Release”) that confirms winner’s (i) eligibility for the Contest and compliance with these Contest Rules; (ii) acceptance of the Prize as offered; (iii) release of each of the Sponsor and its parent companies, subsidiaries, affiliates and/or related companies and each of their employees, directors, officers, suppliers, agents, sponsors, administrators, licensees, representatives, advertising, media buying and promotional agencies (collectively, the “Releases”) from any and all liability for any loss, harm, damages, cost or expense arising out of participation in the Contest, participation in any Contest-related activity or the acceptance, use, or misuse of any Prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and (iv) grant to the Sponsor the unrestricted right, in the Sponsor’s sole discretion, to produce, reproduce, publish, broadcast, communicate by telecommunication, exhibit, distribute, adapt and otherwise use or re-use the Winner’s name, photograph, likeness, voice and biography, in any and all media now known or hereafter devised, in connection with the Contest and the promotion and exploitation thereof. The executed Release must be returned within two (2) business days of the email message notifying the entrant that their entry has been drawn, or the selected entrant will be disqualified and the Prize forfeited.
By entering the Contest, entrant affirms that he or she has read and agrees to abide by the Official Contest Rules. The Sponsor reserves the right to disqualify any entrant acting in violation of the Official Contest Rules or found tampering with the entry process or with the operation of the Contest. The contest is governed by the laws of Canada and, by entering, all Winners and entrants hereby submit to the jurisdiction and venue of the national and local courts located in Toronto, Ontario. Any attempt by entrant or any other individual to deliberately undermine the legitimate operation of the contest may be in violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek damages from such entrant to the fullest extent permitted by law.
The Sponsor and each of its affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents assume no responsibility or liability for lost, late, unintelligible/illegible, falsified, damaged, misdirected or incomplete entries, notifications, responses, replies, or for any computer, online, software, telephone, hardware or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of an entry and are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the administration of the Contest. The Sponsors and each of its affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsors and each of its affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents are not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing or otherwise. The Sponsors and each of its affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents are not responsible for any injury or damage to entrant or to any computer related to or resulting from participating or downloading materials in this Contest. Entrant assumes liability for injuries caused or claimed to be caused by participating in the Contest, or by the acceptance, possession, use of, or failure to receive any Prize. The Sponsors and each of its affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents assume no responsibility or liability in the event that the Contest cannot be conducted as planned for any reason, including those reasons beyond the control of the Sponsors, such as infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of this Contest, the Contest Website, and/or www.jonesnewyorkcontest.ca.
By participating, Winner and entrants agree to release, discharge, indemnify and hold harmless the Sponsor and each of their respective affiliates, subsidiaries, parent corporations, and their officers, directors, employees, representatives and agents from and against any claims made by the Winner, entrants or any other third parties related in any way to the operation of this Contest, as well as any other claims, damages or liability due to any injuries, damages or losses (whether alleged, threatened, or actual) to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any contest-related activity or participation in this Contest.

The Sponsor will use the entrant's personal information only to administer the contest, and will protect the entrant's personal information in a manner that is consistent with its Privacy Policy at www.jonesnewyorkcontest.ca.

By participating in the Contest, entrant: (i) grants to the Sponsor the right to use his/her “Personal Information” including his/her name, telephone number and e-mail address for the purpose of administering the Contest, including but not limited to contacting and announcing the Winner; (ii) grants to the Sponsor the right to use his/her Personal Information for publicity and promotional purposes relating to the Contest, in any and all media now known or hereafter devised, without further compensation unless prohibited by law; and (iii) acknowledges that the Sponsor may disclose his/her Personal Information to third-party agents and service providers of the Sponsor in connection with any of the activities listed in (i) and (ii) above.
The Sponsor reserves the right, in its sole discretion, to terminate the Contest, in whole or in part, and/or modify, amend or suspend the Contest, and/or the Contest Rules in any way, at any time, for any reason without prior notice.
These are the official Contest Rules. The Contest is subject to applicable federal, provincial and municipal laws and regulations. The Contest Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Sponsor. All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest Rules or the rights and obligations as between the entrant and the Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the province of Ontario including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.
